If there was a "warranty" on this product and it did not work, then both seller and manufacturer arguably breached the implied warranty of merchantability. Some states do not allow you to go after a manufacturer due to "privity" issues re: the sale and some do not allow you to go after the seller due to "privity" issues with the warranty giver.

BrandsMart USA - Delivery Driver
I had a delivery scheduled for February 12, 2022. Between the hours of 11am - 2pm, the driver did not show At 2:30pm, I call customer service. They advise me that the driver is running late and will be at my house around 3pm. I waited until 3:45pm and called customer service back. Then I was told that the driver 2 hours away.
